These Terms and Conditions govern your use of the Soils.com website and related services. By accessing the website, requesting a quote, placing an order, creating an account, or using our tools, you agree to these terms.

If you do not agree with these terms, do not use the website or our services.

Soils.com is an online platform for browsing bulk soils, sands, and aggregates, checking location-based pricing, requesting quotes, and coordinating delivery in supported markets.

Materials are sourced from third-party suppliers and deliveries are fulfilled by independent trucking and logistics partners. Soils.com coordinates the transaction and customer experience, but does not mine, manufacture, or directly operate every truck involved in fulfillment.

You may browse products, pricing, and educational tools without an account. Some features, including viewing order history and saved account details, require an account.

If you create an account or sign in using a one-time code or password, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate information and to keep your contact details up to date. We may suspend or terminate accounts used for fraud, abuse, or violations of these terms.

Pricing

Prices shown on Soils.com are based on your delivery ZIP code, the selected material, and the quantity ordered. Displayed prices are intended to reflect delivered pricing for the order you configure.

Prices may change over time. The price shown when you complete checkout is the price charged for that order.

Pricing errors

We work to keep pricing accurate, but obvious pricing errors may still occur. If a listing shows an obviously incorrect price, we may cancel the order and issue a full refund.

Order confirmation

After you place an order, you will receive a confirmation from Soils.com and payment will be processed. Confirmation means we received your order request. It does not guarantee final fulfillment if material availability, access conditions, or operational constraints later make fulfillment impossible.

Quotes

Quote requests are informational and do not create a binding order. A quote becomes an order only when checkout is completed and payment is accepted.

Payment is due at checkout unless we expressly agree otherwise in writing. We currently process online payments through Stripe.

By providing payment information, you represent that you are authorized to use the payment method and that the information you submit is accurate.

Prices are charged in U.S. dollars. Taxes, when applicable, are calculated at checkout based on the order details and delivery location.

Delivery process

Bulk materials are delivered by dump truck and placed at the delivery location you provide. Delivery includes dumping the material, not spreading, grading, compacting, or installation.

Delivery scheduling

Available delivery dates and preferred windows are selected during checkout. These dates are estimates, not guarantees. Weather, supplier availability, truck scheduling, access problems, and other operational issues can delay fulfillment.

Site access and placement

You are responsible for making sure the site is accessible to a loaded dump truck and for giving complete placement instructions. If the truck cannot safely reach the requested drop point, the driver may place the material at the nearest safe and accessible location.

Delivery confirmation

We may provide delivery confirmation and, where available, photo proof after placement. If you are not present, the delivery may still be completed according to the instructions you provided.

Quantity variance

Bulk materials are loaded by weight or volume at the source. Natural loading and hauling variances can occur. Minor variances that fall within normal industry tolerances are not grounds for cancellation or refund.

Natural variation

Soils, sands, and aggregates are natural products. Color, texture, moisture, composition, and particle size can vary by source and batch. Product photos and descriptions are representative and may not exactly match the delivered load.

Specifications

If a product page references an industry or agency specification, that information is based on supplier-provided information unless otherwise stated. If specification compliance is critical to your project, contact us before ordering.

Project suitability

Product descriptions, calculators, and usage guidance are general information only. You remain responsible for determining whether a material is appropriate for your project, permit requirements, or engineering conditions.

Cancellation by you

You may request cancellation before the order is assigned, loaded, or dispatched. Once fulfillment work has materially begun, cancellation may not be possible or may be subject to partial charges.

Cancellation by us

We may cancel an order if material becomes unavailable, a pricing error occurred, the address is outside our service coverage, access is unsafe, or we suspect fraud or misuse.

Refunds after delivery

Delivered bulk materials generally cannot be returned because they are dumped on site and cannot be practically re-collected or resold. If you believe the wrong material was delivered or there was a material issue, contact us promptly with photos and order details.

Refund timing

Approved refunds are issued to the original payment method. Processing times depend on your payment provider and bank.

When you use Soils.com, you agree to:

• Provide accurate contact, delivery, and access information.
• Ensure the site is accessible and safe for a dump truck delivery.
• Be reachable on the delivery date, or designate someone who is.
• Disclose site constraints such as gates, slopes, overhead lines, or soft ground.
• Use the website lawfully and not for fraud or abuse.
• Respect our content, trademarks, and intellectual property.

To the maximum extent permitted by law, Soils.com is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the website or services.

This includes, without limitation, losses related to weather delays, material suitability, normal product variation, access-related property damage risks inherent in heavy truck delivery, or operational issues beyond our reasonable control.

If we are found liable for a claim related to an order, our total liability will not exceed the amount you paid for that specific order.

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

If a dispute arises, you agree to first contact us at [email protected] so we can try to resolve it in good faith.

If the dispute cannot be resolved informally, either party may pursue available remedies in the courts or forums that have jurisdiction under applicable law. You agree not to participate in class claims to the extent permitted by law.

All website content, including text, graphics, logos, images, product descriptions, software, design, and branding, belongs to Soils.com or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, republish, distribute, modify, create derivative works from, or exploit our content without prior written permission, except as allowed by law.

We may update these terms from time to time. When we do, we will update the date at the top of this page.

Your continued use of Soils.com after updated terms are posted means you accept the revised terms.
